Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and FusionICT ("we", "us") for your use of the Susta app and website (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live) to use the Service, and able to form a binding contract. If you use the Service on behalf of someone else, you confirm you're authorised to accept these Terms for them.

3. What Susta is — and is not

Susta helps you evaluate foods, plan and cook meals, and keep a personal wellness record, with verdicts drawn from a cited, evidence-graded engine. It is a general wellness and educational tool.

Susta is not a substitute for professional medical, nutritional, or health advice. It does not diagnose, treat, cure, or prevent any disease, it is not a medical device, and it does not give advice about any medication — including whether to start, stop, change, or dose one. Evidence grades reflect the strength of general scientific evidence, not a recommendation for your individual situation. You are responsible for decisions you make, and you should consult a qualified professional before acting on anything in the Service, especially if you have a medical condition, are pregnant, or take medication.

4. Your account & backup

The Service works without an account. If you choose to enable backup, you may sign in with an email, a Google account, or an anonymous device account. You're responsible for keeping your credentials secure and for activity under your account. Tell us promptly of any unauthorised use.

5. Acceptable use

You agree not to:

• use the Service unlawfully, or to harm, harass, or infringe the rights of others;
• reverse engineer, scrape, overload, or attempt to breach the security of the Service, except as permitted by law;
• resell, redistribute, or commercially exploit the Service or its content without our permission;
• submit false, misleading, or infringing content, including to any community database through the Service;
• rely on the Service as a source of medical advice or as a medical device.

6. Your content & data

Your profile and record are yours. You keep all rights to the information you enter. You grant us only the limited licence needed to operate the Service for you — for example, to store your data on your device, to sync it to your private cloud space if you enable backup, and to process the specific requests you make (such as a barcode lookup or a photo estimate), as described in the Privacy Policy. You can export or delete your data at any time.

7. Intellectual property

The Service — including its software, design, brand, verdict engine, evidence base, and written lessons — is owned by FusionICT and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial wellness use. All rights not expressly granted are reserved. "Susta" and related marks are ours; don't use them without permission.

8. Third-party data & services

Packaged-food information is provided by Open Food Facts contributors under the Open Database Licence (ODbL), and by the USDA FoodData Central database. Certain features use Google Firebase and Google Cloud services. Third-party data may be incomplete or inaccurate, and third-party services are governed by their own terms. We're not responsible for third-party content or services.

9. Subscriptions (Susta Plus)

Core features — scanning, verdicts, the basic plan, the coach, your own-data export — are free. Some features may be offered as a paid "Susta Plus" subscription. During beta, Plus is provided free as a preview and may change. If and when paid plans launch, pricing, billing, renewal, and cancellation terms will be presented to you before you subscribe, and purchases made through an app store are also subject to that store's terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that verdicts, evidence grades, estimates, or other outputs are accurate, complete, or suitable for your circumstances, or that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all such warranties.

11. Limitation of liability

To the fullest extent permitted by law, FusionICT and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless FusionICT from claims and expenses arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by law.

13. Termination

You may stop using the Service and delete your data at any time. We may suspend or end your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

14. Changes to the Service & Terms

We're actively developing Susta and may add, change, or remove features. We may also update these Terms; we'll revise the "last updated" date and, for material changes, give more prominent notice. Continued use after an update means you accept the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which FusionICT is established, without regard to its conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction over disputes, unless mandatory local consumer law provides otherwise. Nothing here limits consumer rights that cannot be waived under the law that applies to you.
